An ‘Open’ meeting of the City Council was held in the Council Chamber, Burnaby City Hall, 4949 Canada Way, Burnaby, B.C. on Monday, 2015 April 27 at 7:00 PM followed immediately by a ‘Closed’ meeting from which the public was excluded.  At the conclusion of the ‘Closed’ meeting, the ‘Open’ meeting was reconvened at 7:00 PM in the Council Chamber.

A)

Public Art in Burnaby

Presenters: Denis Nokony, Assistant Director - Cultural Services & Ellen van Eijnsbergen, Visual Arts Coordinator

 

 

Mr. Denis Nokony, Assistant Director – Cultural Services appeared before Council to provide an overview of the public art program in Burnaby. Mr. Nokony advised that in 2005, Burnaby Parks & Recreation Commission developed a policy to help regulate the acquisition of artworks in public places and that the Planning and Building Department works with private sector developments and institutions to introduce and regulate public art projects into private spaces.

 

Mr. Nokony announced that in 2014, Burnaby Art Gallery staff conducted an inventory of all public art throughout the city and that this information is continuously updated and available to the public on Burnaby’s website.

 

Mr. Nokony then introduced Ms. Ellen van Eijnsbergen, Visual Arts Coordinator, who was in attendance at the Council meeting to present an overview of the City of Burnaby’s 2014 Public Art Inventory.

 

Ms. Ellen van Eijnsbergen, Visual Arts Coordinator, with the assistance of a PowerPoint presentation, highlighted Burnaby’s Public Art Inventory, consisting of the following seven categories:

·         Civic Art: Permanent Art Collection

·         Civic Art: Heritage and Memorial

·         Community Art

·         Private Development Public Art

·         Public Access Private Art

·         Public Access SFU Art

·         Removed Public Art.

 

At the conclusion of her presentation, Ms. Van Eijnsbergen thanked Council for its ongoing support, and also for the opportunity to present the City’s Public Art Inventory. A copy of the inventory document was provided to each member of Council and is available online and in the City Clerk’s Office.

Ms. Annette Taylor, member of the BC Government Employees Union, appeared before Council representing the New Westminster and District Labour Council to speak about the annual "Day of Mourning for Workers Killed and Injured on the Job". Ms. Taylor advised that April 28th each year is recognized nationally as a day to mourn those workers who have been killed or injured on the job. This day also provides an opportunity to rededicate ourselves to improving working conditions through education and prevention initiatives.

 

Ms. Taylor provided Council with up-to-date information on workers' health and safety issues, WorkSafeBC regulatory reviews and/or changes that have impacted B.C.'s workplace and, accident and fatality rates. Last year, 203 workers in B.C. did not return home from work.

 

Ms. Taylor made reference to two workplace explosions; one at Babine Sawmill in Burns Lake and the other at the Prince George Lakeland Sawmill. These explosions caused the death of 4 workers and injured 44. The speaker encouraged everyone to take a minute of their time and visit the website www.usw.ca and sign the petition demanding the Provincial Government call for a public inquiry into both sawmill explosions.

 

His Worship Mayor Derek Corrigan proclaimed April 28th, 2015 as "Annual Day of Mourning for Workers Killed and Injured on the Job" in the City of Burnaby.

 

Mayor Corrigan announced that a ceremony will be held at Burnaby City Hall on April 28, 2015 at 11:00 a.m. recognizing and mourning workers who have been killed or injured on the job.

 

Mayor Corrigan then called for one minute of silence to remember those workers who have been killed or injured on the job.

The City Manager presented a report dated 2015 April 27 on the matters listed following as Items 01 to 15 either providing the information shown or recommending the courses of action indicated for the reasons given.

MANAGER'S REPORTS

 

 

1.

OIL SPILL IN ENGLISH BAY, VANCOUVER - MV MARATHASSA

 

 

The City Manager submitted a report from the Director Engineering and the Fire Chief providing Council with information on the recent oil spill in English Bay from MV Marathassa and also providing information on potential implications to Burnaby for any similar occurrences within Burrard Inlet in the future.

Staff advise that the recent oil spill in English Bay from MV Marathassa on 2015 April 08 has clearly identified the need for a more coordinated and effective spill recovery response and an improved notification process. This incident also raised questions regarding the capacity of responders (responsible parties, agencies and contractors) to effectively respond to larger oil spills in a timely manner from an oil tanker with Burrard Inlet. In the case of the Trans Mountain Expansion Project, Council has raised a number of questions to the National Energy Board pertaining to oil spill and related impacts from oil tankers arriving at the Westridge Marine Terminal. Staff concluded at the incident in English Bay just confirms that concerns which have been previously expressed by Council.

2. THAT a copy of this report be forwarded to the Minister of Fisheries and Oceans, Burnaby MLA's, Burnaby MP's and the Environment Committee.

LOCAL SERVICE TAX BYLAW

 

 

The City Manager submitted a report from the Director Finance seeking authorization to impose a 2015 Local Service Tax Bylaw for works completed between 2014 June 01 and 2015 May 31.

1. THAT Council authorize staff to prepare a 2015 Local Service Tax Bylaw to impose a local service parcel tax for completed local improvement works on the benefiting properties included in Attachment 1, 2015 Schedules 1 to 12

The City Manager submitted a report from the Director Parks, Recreation & Cultural Services Finance requesting approval for the 2015/2016 Facility Use Fee Schedule and to bring forward the fees bylaws.

 

The City Manager recommended:

1. THAT approval be given for the 2015/2016 Facility Use Fee Schedule (Attachment "A") as outlined in this report and circulated under separate cover.

2. THAT the Burnaby Recreation Fees and Admissions Bylaw 2015, the Burnaby Shadbolt Centre and Burnaby Art Gallery Rental Fee Bylaw 2015, and the Burnaby Village Museum Fees Bylaw 2015 be brought down as detailed in Attachment "A" circulated under separate cover.

The City Manager submitted a report from the City Clerk recommending approval of a Corporate Policy to preauthorize members of Council to attend Federation of Canadian Municipalities (FCM) Annual Conference, Union of BC Municipalities (UBCM) Annual Convention and the Lower Mainland Local Government Association (LMLGA) Annual Conference.

1. THAT Council authorize the installation of banners by Simon Fraser University on City utility poles, as outlined in this report.

REZONING REFERENCE #13-05
TOWNHOUSE PROJECT WITH UNDERGROUND PARKING
ROYAL OAK COMMUNITY PLAN

The City Manager submitted a report from the Director Planning and Building seeking Council authorization to forward this application to a Public Hearing on 2015 May 26.

The City Manager recommended:

1. THAT the sale be approved in principle of City-owned property at 7029 Royal Oak Avenue in accordance with Section 3.4 of this report and subject to the applicant pursuing the rezoning to completion. 

2. THAT a Rezoning Bylaw be prepared and advanced to First Reading on 2015 May 04 and to a Public Hearing on 2015 May 26 at 7:00 p.m.

3. THAT the following be established as prerequisites to the completion of the rezoning:

a. The submission of a suitable plan of development.

b. The deposit of sufficient monies, including a 4% Engineering Inspection Fee, to cover the costs of all services necessary to serve the site and the completion of a servicing agreement covering all requisite services. All services are to be designed to City standards and constructed in accordance with the Engineering Design. One of the conditions for the release of occupancy permits will be the completion of all requisite services.

c. The installation of all electrical, telephone and cable servicing, and all other wiring underground throughout the development, and to the point of connection to the existing service where sufficient facilities are available to serve the development.

d. The consolidation of the net site into one legal parcel.

e. The granting of any necessary statutory rights-of-way, easements and/or covenants.

f. The undergrounding of existing overhead wiring abutting the site.

NEW BUSINESS

 

 

Councillor Paul McDonell made reference to the recent earthquake in Nepal and advised that 18 Burnaby firefighters have volunteered their time to serve as a rescue team in Nepal. The firefighters are currently enroute, with thanks to Cathay Pacific Airlines for providing the flights. Councillor McDonell also advised there will be no cost to the City for this rescue mission, other than providing the equipment that the firefighters need during their rescue efforts. At this end, Burnaby firefighters will cover their colleague's shifts during their absence.

Councillor McDonell commended the firefighters involved for their willingness to assist in the rescue and recovery following the earthquake disaster in Nepal.

 

Councillor McDonell recalled that approximately one year ago, B.C. Ambulance Service changed its dispatch protocol for emergency calls. B.C. Ambulance Service prioritizes how ambulances are dispatched based on the caller's description of the nature and extent of the medical condition or injury. Councillor McDonell pointed out that when a person is calling in a medical emergency, it is very difficult to determine the extent of the emergency as people react in different ways to emergencies. The new dispatch protocol has proven to cause a negative impact on response times during medical emergencies. Councillor McDonell

 

stressed that B.C. Ambulance Service's new system is not working, it compromises patient health and is therefore totally unacceptable. These concerns have also been raised by many Burnaby citizens through letters and emails.
