An Open meeting of the City Council was held in the Council Committee Room, Burnaby City Hall, 4949 Canada Way, Burnaby, B.C. on Monday, 2016 January 18 at 6:32 p.m. followed immediately by a Closed meeting from which the public was excluded.  At the conclusion of the Closed meeting, the Open meeting was reconvened at 7:03 p.m. in the Council Chamber.

Re:  Correction of Information

Speaker:  Helen Hee Soon Chang

 

 

Ms. Helen Hee Soon Chang appeared before Council purporting that someone has wrongly used her business name to seek and obtain multiple business licenses in the City of Burnaby.

 

Ms. Chang provided written details of the business names that have been registered using variations of her business name, and requested that the City of Burnaby strike this incorrect information from the City’s records.

 

Council members noted these concerns should be directed to the City’s business license department, and suggested she contact staff in that department to pursue her concerns.

Canadian Wildlife Service - Environment Canada

Re: Species at Risk Act

Speaker: Danielle Prevost

 

 

Ms. Danielle Prevost, Canadian Wildlife Service - Environment Canada, appeared before Council providing information on the Species at Risk Act (SARA), its impacts on the community, what the Environment Canada does and how they can support the City of Burnaby.

 

The speaker noted that the Government of Canada introduced the Species at Risk Act to protect endangered and threatened species, and the spaces they need to flourish. 

 

It was noted that the Federal Government is responsible for Canadian inland and territorial waters, and all aquatic species and migratory birds.  The Federal Government has a role in assessing whether species are protected by the Provinces and Territories.  The Provinces and Territories are primarily responsible for the majority of Canadian lands.

 

Ms. Prevost advised that critical habitat protection collaboration could include partnerships, such as the South Coast Conservation Program; Regional Biodiversity Conservation Strategy; mapping, technical  and planning support; co-developed resources, i.e. stewardship practices, and others.

 

The speaker reviewed a three-year plan for Burnaby on species at risk:

·         Extirpated – Pacific Gophersnake

·         Threatened – Common Nighthawk

·         Assessed as Threatened – Barn Owl

·         Special Concerns – Ancient Murrelet, Great Blue Heron, Monarch Butterfly, Western Screech Owl, Band-tailed Pigeon, Northern Red-Legged Frog, Northern Rubber Boa, Peregrine Falcon, Short-eared Owl, Spotted Bat, Western Toad, and Vancouver Island Beggarticks

 

In conclusion, Ms. Prevost noted that several consultation documents will be send to the City of Burnaby, in the near future, seeking feedback and possible collaboration.

 

C)

South Coast Conservation Program

Re: Opportunities to Protect Species and Ecosystems at Risk

Speaker: Christine Cooper, Conservation Planner

 

Ms. Christine Cooper, Conservation Planner, South Coast Conservation Program, appeared before Council providing information on conservation efforts for species and ecosystems at risk.

 

The speaker noted there are 268 species threatened, endangered and special concern Provincially, and about 57 (including 3 extirpated) Federally.

 

Ms. Cooper noted some of the benefits of protecting species and ecosystems at risk, i.e. biodiversity is important to community health and well-being; resilient ecosystems equal resilient vibrant economies; high quality recreational experiences; continued flow of ecosystem services (i.e. clean air, water, food security).

 

In conclusion, the speaker advised that South Coast Conservation Program provides local governments with individualized guidance and training, and facilitates the sharing of conservation-based knowledge and expertise across jurisdictions.

Burnaby Power and Sail Squadron

Re: Request to Post Signs

 

 

A letter was received from Burnaby Power and Sail Squadron seeking Council approval to place temporary signs on street right-of-ways to promote safe boating classes.

 

A staff note advised a motion of Council is required to permit the temporary placement of signs on street right-of-ways.

THAT Council approve the request from Burnaby Power and Sail Squadron for temporary signs to be placed on public property to advertise their safe boating classes, and that staff work with the organizers to determine appropriate timing, location and number of signs to be placed on City boulevards.

MANAGER'S REPORTS

 

 

1.

LICENCE AGREEMENT - BURNABY LAKE ROWING CLUB

 

 

The City Manager submitted a report from the Director Parks, Recreation & Cultural Services seeking Council approval to renew an operating agreement with the Burnaby Lake Rowing Club (BLRC). The continuance of this agreement allows BLRC to manage access and scheduling of activities on the rowing course under the supervision of the City.

The City Manager recommended:

1.      THAT approval be granted to renew an operating agreement with the Burnaby Lake Rowing Club (BLRC) for an additional five year term beginning 2016 January 01 and ending on 2016 December 31 under the terms and conditions outlined in the attached report.

The City Manager submitted a report from the Director Planning and Building seeking a Council resolution to file a notice in the Land Title Office pursuant
to Section 57 of the Community Charter, with respect to a property in contravention of Burnaby Building, Plumbing, Gas and Electrical Bylaws. 

 

The City Manager recommended:

 

1.       THAT Council direct the City Clerk to file a Notice in the Land Title Office against title to the subject property stating that:

 

         a)   a resolution relating to the land has been made under Section 567 of the Community Charter; and,

 

         b)   Further information respecting the resolution may be inspected at the offices of the City Clerk, City of Burnaby;

1.      THAT strata titling of 7369 Stride Avenue be approved subject to complete satisfaction of the Guidelines for Conversion of Existing and Occupied Two-Family Dwellings into Strata Title Units.

1.      THAT Council approve payment of the invoice from the Federation of Canadian Municipalities for the 2016 membership dues in the amount of $36,054.88.

1.      THAT Council authorize the expenditure of approximately $6,400.00 for Shara Noble (Information Technology Database Administrator) to attend Oracle 12c training in Toronto, Ontario.

The City Manager submitted a report from the Director Finance seeking Council approval to award a contract for civil engineering and construction services for the 2016 Kaymar Creek Erosion Mitigation Project.

The City Manager recommended:

1.       THAT Council approve a contract award to Associated Engineering Ltd. for a total cost of $304,523.10 including GST in the amount of $14,501.10 as outlined in this report.

NEW BUSINESS

 

 

            Liquor Policy Consultation – Councillor Dhaliwal

 

            Councillor Dhaliwal made reference to a January 13, 2016 UBCM newsletter       advising that the Provincial Government will be accepting feedback from local            governments on three liquor policy issues: change to the manufacturer’s     endorsements; the parallel process for liquor policy primary and similar            applications; and, policy related to liquor primary clubs.  The deadline for   feedback is February 5, 2016.

 

            Councillor Dhaliwal noted the City of Burnaby has its own policies around liquor            licensing, and suggested staff should review the proposed Provincial changes to      see if this would give rise to any conflict with existing City policy.
